When a hotel is listed as "pet-free" and it's not, what, if any laws are being broken?
I work the front desk of a "pet-free" hotel. My GM, however, randomly lets people with pets stay. We are listed in multiple publications as being "pet-free". I've tried to explain, to no avail, that if you have signs posted, then you CANNOT let pets in. I would like to show him what the laws say exactly on this subject. Me telling him we are liable if something should occur seems to not be enough. Please help!
There is no specific law requiring hotels to be pet-free even if they claim to be pet-free.
The liability would rest with the fact that a person renting a room in a hotel listed as pet-free would have a reasonable expectation to be free of complications caused by the presence of animals. For example, if a patron complained due to noise from a pet, you would have no recourse other than to refund their money. If a patron suffered an allergic reaction from staying in a room that they expected to be free from animal hair, then they could pursue damages against the hotel for misleading them into thinking that the room would be free from such a condition.
Your manager is opening the door to possible civil liability and negligence claims, but that's about it.
